Overview
Code of Virginia §15.2-2308 requires any zoned locality to establish a Board of Zoning Appeals (BZA). The seven-member board does not have seats based on local districts. Under §15.2-2308 and the BZA’s bylaws, which are established pursuant to the aforementioned state code, members must be “residents of the locality.” The Board of Supervisors may make recommendations on BZA appointments, but vacancies are filled at the sole discretion of the circuit court.
The BZA serves as an appellate body for persons aggrieved of any zoning decision or determination made by county staff. The BZA also serves as the review agency with specific discretionary authority to approve or deny variance requests to specific code sections in the county’s local zoning ordinance.
BZA members are appointed and sworn in by the Circuit Court and serve five-year terms.
